BROOT Coffee Roasters is a brand of M/s Taman Beverages, a sole proprietorship of Taman Deep Singh Makan, registered at Ground Floor, Plot No. 86/3, Block-A, Wazirpur Industrial Area, New Delhi, North West Delhi, Delhi 110052, India. 1. These terms

These Terms of Service govern your use of brootcoffee.com and everything you buy from it. By browsing the store or placing an order you agree to them, together with our refund policy, shipping policy and privacy policy, which form part of these terms. If you do not agree with them, please do not use the store.

2. Who can buy

You must be 18 or older to place an order. When you give us your name, address, phone number and email, you confirm they are correct and yours to give. You are responsible for your account and for anything done through it, so keep your password to yourself.

3. Our coffee

We roast to order. Coffee is an agricultural product and a harvest is finite: a lot can sell out, and the next crop from the same estate will not taste identical to the last. Tasting notes describe what we find in the cup, not ingredients added to it. Bag and label appearance may differ slightly from the photographs, and screens render colour differently. We may change or discontinue any product at any time, and we may limit quantities where a lot is scarce.

4. Orders

An order you place is an offer to buy. It becomes a contract when we confirm acceptance, which normally happens with the order confirmation email. We may decline or cancel an order — for example where a lot has run out, where a price or description was wrong, or where we cannot verify the address or payment — and if we do, we refund you in full and tell you why. Because your coffee is roasted for you, cancellation after roasting has begun is covered by our refund policy.

5. Prices, GST and payment

Prices are in Indian rupees and include GST at the applicable rate. Delivery is charged separately and is set out in our shipping policy. The price that applies is the one shown when you place the order, and it is repeated on your confirmation. Prices, offers and promotions can change without notice, and an offer has whatever terms are stated with it. Payment is taken through our payment providers; card and UPI details go straight to them and are never stored by us.

6. Delivery

We ship within India only. Dispatch times, delivery estimates and delivery charges are in our shipping policy. Delivery estimates are the courier's, not a guarantee. Title and risk in the goods pass to you on delivery, which is why a parcel damaged in transit is ours to put right.

7. Returns and refunds

Everything about cancellations, damage, wrong items, refunds and the First Bag Promise is in our refund policy. Your rights under the Consumer Protection Act, 2019 are not limited by these terms.

8. Subscriptions

A BREWKEEPER subscription renews on the cycle you chose until you cancel it. You can skip, pause or cancel from your account or by writing to us, before the roast date of the next cycle. Prices can change on renewal; we tell you before they do.

9. Wholesale and consultancy

Supply to cafes, restaurants, hotels and offices, and any consultancy or training engagement, is governed by the proforma invoice, quotation or supply agreement signed for it. Where that document and these terms conflict, that document wins.

10. Our intellectual property

The BROOT name, wordmark, packaging, photography, product descriptions, tasting notes and everything else on this site belong to us or to our licensors and are protected under the Copyright Act, 1957, the Trade Marks Act, 1999 and related Indian law. You may use the site for your own personal, non-commercial purposes. You may not copy, republish, scrape, mirror or resell any part of it, or use our name or marks, without our written permission.

11. Reviews and anything you send us

If you post a review, a photograph or a suggestion, you give us permission to use, reproduce and display it in connection with BROOT, without payment. You confirm it is yours to give and that it is not unlawful, abusive, obscene, misleading or someone else's work. We may decline or remove content, and we are not obliged to keep, publish or reply to what you send.

12. How you may not use the store

You may not use the site for any unlawful purpose, break any Indian law through it, infringe anyone's rights, harass or abuse our staff, submit false information, send spam, impersonate anyone, upload malware, harvest other people's personal data, or interfere with the security of the site. We may suspend or close an account that does any of this.

13. Automated access and agents

Scraping, crawling, mirroring or bulk-extracting our catalogue, prices, photography or descriptions by any automated means is not permitted, and neither is using an automated agent that conceals what it is. Any software agent acting for you must identify itself in its user agent string, must not imitate a human to get past a check, must answer truthfully when asked whether it is automated, and must respect our robots.txt and any technical limit we set. We may block automated traffic at our discretion.

14. Third-party tools and links

The store uses third-party tools and may link to other sites. We do not control them, we provide them as they are, and we are not responsible for their content, their terms or anything you buy from them. Read their policies before you use them.

15. Our relationship with Shopify

BROOT is powered by Shopify, which enables us to provide this store to you. Any sale or purchase you make here is made directly with BROOT. Shopify is not responsible for any aspect of it, including any injury, damage or loss arising from products bought here, and you release Shopify and its affiliates from all such claims.

16. Privacy

What we collect and why is in our privacy policy. Because the store is hosted by Shopify, some of your data is processed by Shopify and its sub-processors, including outside India.

17. What we do not promise

We describe our coffee as accurately as we can, but we cannot promise that a particular cup will suit a particular palate, that the site will always be available or error-free, or that every listing is free of typographical error. Where a price or description is obviously wrong, we may correct it and cancel affected orders with a full refund. Nothing here excludes any warranty or condition that Indian law does not permit us to exclude.

18. Our liability

To the extent Indian law allows, our total liability to you for any claim connected with an order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss, including lost profit or lost business. Nothing in this clause limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.

19. Indemnity

If you break these terms or the law and that causes a third party to claim against us, you agree to cover our reasonable losses and legal costs arising from it. We will tell you promptly about any such claim.

20. Events outside our control

We are not in breach of these terms if we are delayed or prevented by something beyond our reasonable control — a courier strike, a natural event, a power or network failure, a crop failure at origin, or a government restriction. We will tell you and, where a delay is long, refund you.

21. Suspension and ending this agreement

We may suspend or close your access to the store if you breach these terms. You remain liable for amounts already owed. Clauses on intellectual property, content you send us, liability, indemnity, governing law and anything else that by its nature should continue, survive.

22. Complaints and grievance redressal

Appointed under the Consumer Protection (E-Commerce) Rules, 2020 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. We acknowledge within 48 hours and resolve within one month.

23. Governing law

These terms are governed by the laws of India. Any dispute is subject to the exclusive jurisdiction of the courts at Delhi. If any clause is held unenforceable, the rest stands.

24. Changes

We may update these terms and will change the date at the top when we do. Continuing to use the store after a change means you accept it.
